Notification and fees

All cosmetic products that are sold on the EU market shall be notified to the cosmetics register (CPNP). Swedish companies notified to the CPNP pay an annual fee to the Swedish MPA, which is responsible for performing market surveillance of cosmetic companies.

Cosmetics register (CPNP)

The EU Commission has a cosmetics register, the Cosmetic Products Notification Portal (CPNP). This applies to all EU/EEA Member States.

The product’s full name, among other things, and the responsible person for the product must be registered in the CPNP. A ‘frame formulation’ for the contents of the product is also registered and, in certain cases, more precise information regarding the contents, so that the CPNP may be used by poison information centres.

Notification to the CPNP is not the same as approval or authorisation for a product. It is a registration which shows that the product is available on the EU market and who is responsible for the product.

Notification to the CPNP

  • It is the responsible person and distributors who themselves translate the label on the product who is obliged to notify products to the CPNP.
  • Notification shall be given to the CPNP before the products are sold.
  • In the case of importing cosmetic products into the EU/EEA, each importer is the responsible person who shall notify their imported products to the CPNP.

Products imported into the EU/EEA may therefore be notified several times to the CPNP by different responsible persons. Notification of cosmetic products to the CPNP is done electronically.

Fees payable to the Swedish MPA for cosmetics

The Swedish MPA’s control of products on the Swedish market is financed by fees. An annual fee is charged to businesses that have the role of responsible person for cosmetic products and from ‘translating distributors’ of cosmetic products. When the Swedish MPA is has performed market surveillance of distributors not obliged to notify to CPNP, a fee is charged based on an hourly rate.

Annual fees

The Swedish MPA charges an annual fee to those who are responsible for notifying cosmetic products to the Cosmetic Products Notification Portal (CPNP), i.e. the responsible person or distributor who translates the labelling of cosmetic products themselves.

  • Administrative fee: SEK 4 000
  • Fee per product in the range: SEK 600

For notification purposes, each collection of ingredients is counted as a separate product. However, there are exceptions:

  • a collection of colours of a product with a common product name, where the colour is the only difference between the products in the collection, may be notified as one product
  • different package sizes of the same product may be notified as one product.

However, scent variations of a product are notified as separate products.

The Swedish MPA receives information on when Swedish businesses notify products to the CPNP and use this information as a basis for invoicing the annual fee. Therefore, notification of products does not need to be made to the Swedish MPA.

If you have more than 200 products, no fee is paid for the products that exceed 200.

Hourly rate

The hourly rate is a fee that the Swedish MPA charges the party who is acting as distributor and who is not obliged to notify their cosmetic products to the CPNP. The hourly rate is charged after performing market surveillance of the time spent processing the case. The fee is SEK 750 for each hour or part thereof.

Voluntary notification for distributors

A distributor who is not obliged to notify cosmetic products to CPNP may perform a voluntary notification to the Swedish MPA. This refers to distributors who do not need to translate labeling for their cosmetic products into Swedish to meet Sweden’s requirements for language. It may be that the distributors products are already provided with mandatory Swedish labeling or that labeling in Swedish is not required for the product.

Voluntary notification means that the annual fee must be paid to the Swedish MPA. Those who have voluntarily notified and paid the annual fee do not need to pay the hourly rate in the event of any performed market surveillance by the Swedish MPA. Please note that voluntary notification only applies to distributors who are not obliged to notify to CPNP.

Deregistration of products

At the end of each year, the Swedish MPA sends out a list of notified products to the company. The list forms the basis for invoicing annual fees for the coming year.

Products that are no longer sold may be deregistered with the Swedish MPA. The company may also notify in the CPNP that the products are no longer sold.
